1. Acceptance of terms

These Terms & Conditions govern your use of nibracs.com (the "Site"), operated by Inovocare Healthsoft Solutions Pvt. Ltd. ("Inovocare", "we", "us"). By accessing this Site, you agree to these terms.

2. Purpose of this Site

This Site provides informational content about the NIBRA-CS® autonomic function testing system for hospitals, diagnostic centres, and institutional buyers. Content on this Site is intended for healthcare professionals and institutional procurement audiences and does not constitute medical advice.

3. Not a substitute for clinical judgment or the Operator's Manual

Information about tests, reports, and clinical indices on this Site is a simplified, informational description of NIBRA-CS® device capability. It is not a substitute for professional medical judgment, and it is not a substitute for the current Operator's Manual and Test and Report Reference supplied with the device. Where this Site and the current device documentation differ, the device documentation governs for clinical and operational purposes.

NIBRA-CS® provides supportive physiological assessment data only. It is not intended to provide a standalone diagnosis, and the ECG it acquires is not intended for standalone diagnostic ECG interpretation or arrhythmia diagnosis. It is not intended for continuous monitoring, emergency monitoring, or life-support applications. All diagnostic and treatment decisions remain the responsibility of the treating clinician.

4. Regulatory status

NIBRA-CS® (Model NCS-3.0) is manufactured by Inovocare Healthsoft Solutions Pvt. Ltd. under CDSCO Licence No. MFG/MD/2025/000789 (Form MD-5, issued under the Medical Device Rules, 2017), which classifies it as a Class B medical device. It is a Type BF applied part under IEC 60601-1, designed with reference to IEC 60601-1-2 (electromagnetic compatibility), ISO 10993 (biological evaluation of patient-contact components), and ISO 15223-1 (manufacturer symbols). It is intended for use by trained healthcare professionals, under clinical supervision, in adult patients 18 years and above and 30 kg and above, and is not intended for self-operation by patients.

Regulatory clearances referenced on this Site apply to India, where they were granted. Institutions in other jurisdictions should independently confirm applicable regulatory requirements before procurement.

5. Intellectual property

NIBRA-CS® is a registered trademark of Inovocare Healthsoft Solutions Pvt. Ltd. The core device technology is protected by Indian Patent No. 565433 ("A Device for Monitoring a Physiological State of a Subject and a Method Thereof", granted 23 April 2025, in force for 20 years from its 4 September 2023 filing date). The Site's content and design are also the property of Inovocare and may not be reproduced without permission.

Logos of institutions, government bodies, and programmes referenced on this Site — including CDSCO, BIRAC, DST, and IIMCIP — are used only to identify Inovocare's regulatory approvals, funding relationships, or institutional collaborations as described on this Site, and remain the property of their respective owners. Their use does not imply any endorsement beyond the specific relationship stated.

6. Institutional enquiries

Submitting the Institutional Enquiry form does not create a binding purchase agreement. Procurement, pricing, deployment, and device warranty terms are governed by separate agreements executed directly with your institution, and by the warranty terms set out in the Operator's Manual supplied with the device.

7. Limitation of liability

This Site and its content are provided "as is." To the extent permitted by law, Inovocare disclaims liability for any indirect or consequential loss arising from use of this Site. This does not limit any statutory warranty or liability associated with the NIBRA-CS® device itself under applicable medical device regulations or your institution's purchase agreement.

8. Changes to these terms

We may update these Terms & Conditions from time to time to reflect changes in our practices or applicable law. The "Last updated" date at the top of this page reflects the most recent revision; continued use of the Site after an update constitutes acceptance of the revised terms.

9. Severability

If any provision of these terms is found invalid or unenforceable by a court of competent jurisdiction, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

10. Governing law

These terms are governed by the laws of India, with courts in Kolkata, West Bengal having jurisdiction.
